Hoops FNBL Round 10
Isaac, can plus please block XY from any further FNBL threads?
Cheers.

Skip, not entirely true. Yes, there is the old Statute of Frauds (UK) requirement (Law of Property Act SA) that an interest in land be executed in writing.
But nevertheless an oral agreement in relation to an interest in land, that has been part-performed by the parties, can in exceptional circumstances give rise to a binding contract. Similarly, the Statute of Frauds may not protect a person who relies on the 'executed in writing' requirement to knowingly defraud a purchaser.
But kiddies, if you want to buy a house, make sure you get a contract in writing.

Yep skip - this kid is special, just hope he can go again next week.
he has a MASSIVE ammount of work to do in the gym (anywhere tahts sells food) but his court smarts and very very good

LOL at this whole thread...Gold.
Harsh TR, you will get yours.. ; )
I have also put the kybosh on lockie after he reneged on our deal last week.

at least now with Julian Asange out of jail we can look forward to the release of any cables sent to/from our beloved commisioner that may show him to be currupt!

Well, my view, and this has always been the case with this League is..
The initial Offer is a 'verbal offer'. This then needs to be followed by the 'contract signing' of both parties. So both need to then confirm they are happy with the trade.
as for the 'Law' Screw that! I AM THE LAW!

Skip
If we are going to throw in the waiver swap as well, would you swap DJ with my other centre that doesn't play ever!!

Oh dear, now we are getting into law.
XY - What if, for instance, I made 2 offers using the same players to 2 different people?

The law regarding offer and acceptance only requires an offer by party A, with all of the fundamental terms defined with sufficient clarity, that remains open for acceptance (that is, not withdrawn) at the time party B communicates (or in this case, posts) an acceptance.
Bizz, it might be worth your while appealing the decision!
I would have thought if the 'three-way handshake' rule was going to be in place (that is: offer, acceptance, confirmation), you would want that written fairly clearly into the rules.
If you don't want to be bound by an offer you make, either don't make the offer or make it clear it is not an offer capable of acceptance.

Better post the Bloodgers team for this week.
Crosswhite
Loughton
Hinder
Campbell
Shannon (c)
Boucher
Walker
Henare
Howard
Knight

Hmmm interesting offer X. Sticking points would be Shannon - I'd prefer to keep him over Howard - and the fact that I'm trading two players who have played 9 games for two who have played 11. Let me think it over, but if you'd take Howard instead, I'm more likely to agree.

Bizzy, leave it with me, originally wanted that deal so I could get Ellis. Ill let you know ASAP

Wow that was good reading, Agree that Skip has made the right call but also feel for Bizzy as he no doubt would ahve tried to grab Howard.
Bizz, trade.....yep Im still open to offers, what you thinking?

Haha TR, I am pondering possible trades to balance my team up a bit, but not sure what might work yet.
X, I like Madgen, but Hudson is not going to get it done.

What would you have done if you knew the trade hadn't have gone through Bizzy? I guess it is a mute point but just curious.

I see your point Bizzy, thats why it needs to be written into the rules if not already. And as the posts above mention, precedence has been set in previous weeks.
I guess you can still bid for Braswell now though and being third on the wavier order, I am sure you are going to get him..

And my second waiver pick is still up for grabs for the right trade. Some people may need it to pick up the Perth Import coming in, assuming Statman doesn't pick them up.

My view is the trade between Bean and Bizzy hadn't been confirmed.
An offer was made to "test the waters". Bizzy agreed to the offer but Bean had not confirmed the trade and decided it was not in his best interests. If you cannot put a proposal to someone to "test the waters" trades will never happen!
Precedence has been set earlier on in the year when I believe Skip did offer Penney (prior to coming back to the NBL) to me and I agreed, but Skip did not confirm, therefore trade did not proceed.
And then just last week, DB agreed to a trade I proposed last week but because I did not confirm it did not go through - a better offer was made.
I propose to keep the trade process as it stands now as I think it works, but think if it is not in the rules, it needs to be added.

Thanks Skip. And sorry Bizzy, I had fully intended to make that trade because I thought there would be no chance Howard would still be available at a couple of mins to 7! But since he was... Saa Weet!!!
I have a VERY unbalanced team now though. This could still turn out very bad for me if Howard is actually crap!

Last week when TR and Lockie traded players, TR had to confirm before it went through.
Besides that, I have an email here from Skip saying I need to confirm the trade.

I hadn't confirmed it - was close to doing it but noticed noone had bid on Howard when I got home and checked just before 7pm. That was an opportunity too good to miss!

Eddie McGuire can shove a magpie up his arse and sing jingle bells for all I care!

I dont believe anyone has bid on Howard yet.

I will move Scoines onto the Bench and move Dickel to the DNP list please Skip. Thanks for the heads up - don't think it is going to make a difference anyway.

Hmmm - that makes it interesting Skip.....
Shouldnt Howard be listed as a Forward anyway?

I also heard a rumour X that Ron Howard once shook Gabe Freemans hand. That has to put his value up!

Remember that there are 3 others above you X. Lockie or Bizzy might go after the Perth guy.

well what do you consider a fair deal?
Abercrombie or Cooenrad for garlepp?
give me some options....

Lockie
Just heard that Dickel has been injured at training and wont be travelling to Adelaide or Perth this weekend.

oh what to do
take Ellis
Take Howard
