Cash-strapped ex-NBL star hires new lawyer for Gladstone fraud trial

FORMER NBL star, Derek Rucker is out of pocket despite being accused of committing a $20,000 fraud against the Gladstone Amateur Basketball Association.

Defence lawyer Rio Ramos was recently appointed to appear for Mr Rucker in yesterday's mention before Gladstone Magistrates Court as he could not afford to pay his previous lawyer.

The former Port City Power Basketball chairman and men's coach, was charged in 2016 with dishonestly gaining a financial benefit from his employer between July 28 and November 19, 2015; and committing fraud (dishonestly obtaining property) between September 6 and October 1.

While the matter has been before the courts, Mr Rucker, 51, was previously represented by Brisbane solicitor, Robert Burns, who was preparing to contest the charges on November 16.

However, Ms Ramos told the courtroom yesterday her client was no longer represented by Mr Burns, and would soon be represented by herself as her firm was able to offer a lower price.

Ms Ramos asked if the magistrate could "vacate" the current trial date; allowing time to read over the evidence and prepare, given the trial date was only three weeks away.

She said she was not yet in possession of the brief of evidence of the alleged offending - likely to still be in Mr Burns' possession - information that she could not proceed without.

Ms Ramos asked that the trial be de-listed for her firm to read and gather the information needed to decided how to proceed with Mr Rucker's matters.

"We don't have enough time to prepare," she said.

However the request was refused by Gladstone Magistrate Melanie Ho.

Ms Ho said if the trial was de-listed there was no room in the court's calendar for it come before the court again this year.

She said Mr Rucker "needed to understand these are matters that need to proceed".

Fraud charge laid against former NBL player Derek Rucker over alleged money theft

Former Brisbane Bullets basketball player Derek Rucker has been charged with fraud for allegedly stealing more than $20,000 from the Gladstone Basketball Association.

Police have not named the person at the centre of their investigation but the ABC has confirmed Rucker was charged by police in central Queensland yesterday.

Detective Senior Sergeant Luke Peachey said police began investigating the matter after the association made a complaint earlier this year.

"Police will allege that it concerned a credit card which was fraudulently obtained, however that's all that police will be releasing at this stage," he said.

The offences are thought to have occurred between August and November last year.

"Police will allege that the person, the 49-year-old male, was a former employee [of the association] and was in a position of operations manager and head coach of the Port City Power," Sergeant Peachey said.

Port City Power is a team in the Queensland Basketball League.

Police said the man, from the Brisbane suburb of Jamboree Heights, had been issued a notice to appear in the Gladstone Magistrates Court on May 25.

Sergeant Peachey said police were also looking to speak with a second person thought to be involved.

"Police are further investigating, however we don't envisage that today we'll be making any further arrests," he said.

"We would like to speak to this other person in the very near future, however we don't envisage as I say that we'll be making any further arrests today."

Rucker's playing career in the National Basketball League included stints with Brisbane, Newcastle, Townsville and West Sydney.

He runs a basketball academy out of Brisbane now. Selling the dream to parents about skill development and college connections.

The sooner is punted from any basketball the better. He has screwed over a lot of people

Read in the courier mail that because of the successful Commonwealth Games bid for the Gold Coast stadiums for Cairns and Townsville will be getting an upgrade for a total of 3 million dollars. Thats great news for those cities and the clubs of the Crocodiles and the Taipans.

It does not say exactly what the upgrades will be. I don’t think it will be extra seating because unlike the other stadiums which specifically talks about the upgrade of seating it does not mention it for Cairns and Townsville.

Still great news for them to get any extra funding will be a great bonus and the commonwealth games basketball preliminary rounds will be played in those stadiums which is great for fans in cairns and Townsville.
